Terms of Use

Please read these Terms of Use ("Terms") carefully before using the MortgagePulse platform at aiwaw.store ("Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

1. Description of Service

MortgagePulse provides a software-as-a-service platform that enables licensed mortgage professionals ("Agents") to publish personalized mortgage market intelligence dashboards. The Platform displays publicly available market data, housing statistics, and educational content. MortgagePulse is not a lender, mortgage broker, or financial advisor.

2. No Mortgage Advice

The information displayed on MortgagePulse dashboards is for educational and informational purposes only. It does not constitute:

Rate information displayed represents market averages from public sources and is not guaranteed. Actual loan rates, terms, and availability depend on individual borrower qualifications and lender guidelines. Always consult a licensed mortgage professional for advice specific to your situation.

3. Agent Responsibilities

Licensed mortgage professionals who use MortgagePulse agree to:

MortgagePulse provides a compliance reference tool for informational purposes only. The compliance checker is not a substitute for review by a qualified compliance attorney or compliance officer. Agents are solely responsible for ensuring their dashboards comply with all applicable regulations.

4. Intellectual Property

The MortgagePulse platform, software, design, and branding are owned by MaxGio Digital. Market data is sourced from public third-party providers (FRED API, Freddie Mac, Redfin, MBA) and is subject to their respective terms. Agent-provided content (photos, text, disclosures) remains the property of the respective agent.

5. License to Use

Upon purchase, agents receive a non-transferable, non-exclusive license to use the MortgagePulse platform for their individual professional use. License keys may not be shared, sold, or transferred. One license covers one individual mortgage professional's dashboard.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA DISPLAYED IS ACCURATE OR CURRENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MORTGAGEPULSE AND MAXGIO DIGITAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PLATFORM IN THE PRECEDING TWELVE MONTHS.

8. Indemnification

You agree to indemnify and hold harmless MortgagePulse and MaxGio Digital from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Platform, your violation of these Terms, or your violation of any applicable laws or regulations including mortgage advertising regulations.

9. Third-Party Data

Market data displayed on the Platform is sourced from third parties including the Federal Reserve Bank of St. Louis (FRED), Freddie Mac, Redfin, and the Mortgage Bankers Association. We make no representations regarding the accuracy, completeness, or timeliness of such data. Third-party data sources may change their APIs, availability, or terms at any time.

10. YouTube and Embedded Media

Agents may embed YouTube videos on their dashboards. Such videos are subject to YouTube's Terms of Service and Privacy Policy. MortgagePulse is not responsible for the content of embedded third-party videos.

11. Termination

We reserve the right to suspend or terminate access to the Platform at any time if we determine, in our sole discretion, that an agent has violated these Terms, applicable laws, or is using the Platform in a manner that creates legal or reputational risk. No refunds will be issued for terminations resulting from Terms violations.

12. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Utah County, Utah.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
